Warrant Issued for Seth Johnson

An arrest warrant was issued for a Fairbury man after he failed to appear for court as scheduled.Seth W. Johnson, age 37, had been ordered to appear in Jefferson County District Court on Thursday, September 7, 2023, so that he could be remanded to the custody of the Sheriff's Office and complete the remainder of his sentence.Johnson was originally charged with terroristic threats, a class 3A felony, punishable by up to three years in prison and 18 months of post-release supervision, as well as domestic assault, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine.Johnson's arrest stemmed from an incident that occurred on May 25, 2022, when Jefferson County Sheriff's deputies responded to a report of a disturbance at a residence in Fairbury.In a previous court hearing, County Attorney Joseph Casson stated that a shotgun had been found on the premises at the time of Johnson's arrest. The Warrantless Arrest Affidavit also noted the shotgun.In accordance with a plea agreement, the defendant pleaded No Contest to a single charge of assault on January 5, 2023.On March 2, the court sentenced Johnson to 364 days in the Jefferson County Jail. The sentence was deferred to March 10, 2023.The defendant appealed the sentence and was released on a $10,000 (10 percent) bond while the appeal was in process.The mandate of the decision from the Nebraska Court of Appeals on the appeal in this case was received by the District Court on August 14, 2023. Johnson's appeal was denied.When Johnson failed to appear, Judge David J.A. Bargen issued a bench warrant for his arrest.
