Wilber Man Reaches Plea Deal in DUI Case

A Wilber man facing a felony DUI (Driving Under the Influence) charge has reached an agreement that will make the case a misdemeanor.Humberto Ornelas Gonzalez, age 46, appeared in Jefferson County Court on Wednesday, March 26, 2025. Linda Bauer was the presiding judge. The defendant was originally charged with third offense DUI, a class 3A felony punishable by up to three years in prison, followed by nine to 18 months of post-release supervision, $10,000 fine and his driver's license could be revoked for 15 years. The charge is a felony due to prior convictions and a high test. He has prior convictions for DUI on August 17, 2022, and February 14, 2024, both in Seward County.The defendant was also charged with circumventing an interlock device, a class 4 felony punishable by two years in prison and one year of post-release supervision. There is also a charge of possession of a open container of alcohol, an infraction that carries a $100 fine. On March 14, 2025, at approximately 9:43 p.m., a deputy with the Jefferson County Sheriff's office responded to a report of a truck with a flat tire a quarter mile south of Highway 4 and 573 Avenue in Fairbury. Arriving at the scene, the deputy encountered Gonzalez. According to the arrest affidavit, based on the odor of alcohol and slurred speech, the deputy concluded Gonzalez had been drinking. A preliminary breath test resulted in .258. At 10:16 p.m., Gonzalez was placed under arrest.In accordance with a plea agreement, the defendant pleaded no contest to reduced charges of third offense DUI without the high test enhancement, a class W misdemeanor, and attempt of a class 4 felony, which is a class 1 misdemeanor. Judge Bauer ordered a PSI (Pre-Sentencing Investigation). Sentencing is scheduled for July 23, 2025.Gonzalez remains free on a $30,000 (10 percent) bond at this time.
