Wymore Defendants Seek Drug Court

Drug court is a specialized court docket program that helps criminal offenders who have alcohol and other drug dependency problems. In Gage County District Court, defendants have requested to participate in drug court.Davina MorganDavina S. Morgan, age 39, is charged with delivery of a controlled substance, a class 2 felony punishable by up to 50 years in prison, and possession of a controlled substance, a class 4 felony punishable by two years in prison and up to one year of post-release supervision.Morgan was one of five people arrested on Friday, April 22, 2022, when the Gage County Sheriff’s Office executed two search warrants, one in Wymore and the other in Beatrice, as part of an investigation into the distribution of marijuana and methamphetamine in Gage County. The sheriff’s office was assisted in the investigation by the Beatrice Police Department, Nebraska State Patrol, and the Wymore Police Department.According to the sheriff's office, “During the searches of each residence, several items of evidence connected to the distribution of marijuana and methamphetamine were located. A suspected destructive device was located in the house in Beatrice.”During the search of the Wymore residence, Morgan was located inside and she was arrested. Others arrested were Dalton A. Thomsen, age 20, of Beatrice; Hannah A. Thomsen, age 22, of Beatrice; Jarod A. Peden, age 23, of Beatrice; and Randall L. Pohlman, age 43 of Wymore.A hearing will be held on January 26, 2023.Elizabeth SayersElizabeth P. Sayers, age 20, of Wymore, is charged with possession of a controlled substance, a class 4 felony.According to the arrest affidavit, Gage County Deputies responded to a report of a two-vehicle accident in Wymore. One of the drivers was Sayers. The deputy that filed out the affidavit wrote, “During the accident investigation, I seized a small black bag from Sayers, which Sayers denied me from searching. I requested a search of the bag due to details of the investigation showing the bag may be containing a controlled substance or other illegal item.”Without permission to search the bag, the deputy called for a K9 unit to conduct a “sniff.” The dog's behavior indicated “the presence of a controlled substance.”After obtaining a search warrant, the deputy located inside the bag, “a glass smoking device, containing suspected methamphetamine residue, small plastic zip lock baggie containing a white crystallized substance.”The pipe field-tested positive for methamphetamine. The baggie of suspected methamphetamine was weighed and showed a weight of 2.3 grams.The defendant pleaded guilty and will be attending drug court on January 30, 2023.
