Couple Charged with Domestic Assault

Two Fairbury residents were arraigned in Jefferson County Court on Wednesday, May 24, 2023. Both are charged with assault. The alleged victims are each other. Linda Bauer was the presiding judge.
Jefferson County deputies were dispatched to a residence at 12 and B Streets in Fairbury on Friday, May 12 of this year, at approximately 11:15 p.m., in response to a report of a man and a woman “physically fighting,” according to the Warrantless Arrest Affidavit.
Christina D. Weidner, age 35, of Fairbury is charged with third degree domestic assault, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine.
Weidner requested court-appointed counsel and attorney Benjamin Murray was assigned to represent her.
Weidner has appeared in this court multiple prior times. She pleaded guilty to disturbing the peace, a class 3 misdemeanor, on April 26, 2023. The judge fined Weidner $100.
In 2022, Weidner was charged with violating a protection order on three occasions.
Mitchel P. Hager, age 31, of Fairbury, is also charged with third degree domestic assault. He has a prior conviction for domestic assault in Jefferson County, making the charge a class 3A felony punishable by up to three years in prison, nine to 18 months of post-release supervision and a $10,000 fine.

Hager was previously sentenced to 90 days in jail by Jefferson County District Court Judge Vicky Johnson on July 8, 2021.
The defendant was originally charged with assault by strangulation or suffocation, a class 3A felony, as well as violating a protection order, domestic assault and third degree assault, all class 1 misdemeanors. In accordance with a plea agreement, Hager pleaded No Contest to violating a protection order and third degree assault. The remaining charges were dismissed.
Both defendants are scheduled to return to court on June 7.
