Fairbury Woman Sentenced For Third Offense DUI

Amber M. Bonsal, 26, of Fairbury was sentenced to two years of probation in Jefferson County Court on Wednesday, March 16, 2022. Linda Bauer was the presiding judge.Bonsal was originally charged with driving under the influence of alcohol or other substances (DUI), with a high test (.15 or over) and two prior convictions, making this a class 3A felony, punishable by up to three years in prison, 18 months of post-release supervision and a $10,000 fine; refusing to submit to a blood, breathe or urine test, first offense, a class W misdemeanor, and refusing to submit to a preliminary breath test, a class 5 misdemeanor.The defendant was previously convicted of DUI in Gage County Court on April 3, 2017, and in Jefferson County Court on October 28, 2020.In accordance with a plea agreement, Bonsal pleaded Guilty to a reduced charge of third offense DUI, a class W misdemeanor. The remaining charges were dismissed.Judge Bauer had ordered a PSI (Pre-Sentencing Investigation), which was reviewed by the court.Bonsal was represented by Public Defender Scott Gropp, who requested probation for his client, although he noted the PSI was “on the fence” as to whether or not the defendant was a suitable candidate for probation. Gropp said, “She was successfully discharged from probation last time.”County Attorney Joseph Casson said, “I would not oppose probation.”Judge Bauer said, “I do want to give you another chance on probation.”In addition to two years of probation, Bonsal was fined $1,000 and given a mandatory 30 day jail sentenced.The defendant has been approved for house arrest with an ankle monitor.
