Man Who Missed Court for Misdemeanor Now Faces Felony Charge

A Fairbury man charged with a misdemeanor failed to appear for court and, after his arrest, now faces a felony charge.Cory L. Nutsch, age 34, of Fairbury, was arraigned in Jefferson County Court on Wednesday, April 17, 2024. Linda Bauer was the presiding judge.Nutsch is charged with possession of methamphetamine, a class 4 felony punishable by up to two years in prison, nine to 12 months of post-release supervision and a $10,000 fine. He is also charged with possession of drug paraphernalia, an infraction that carries a $100 fine.Nutsch was originally arrested on June 7, 2023, and charged with first degree criminal trespass, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine. He was free then on a $3,500 (10 percent) bond.He failed to appear for a court date on Wednesday, August 9, 2023, and a warrant was issued for his arrest.On March 20, 2024, a Nebraska State Trooper pulled into a gas station in Fairbury. According to the arrest affidavit, the trooper saw an individual at a pump that he recognized as the defendant.Nutsch was arrested. The trooper reported that, during a search of the suspect, he discovered, “a metal straw.”The trooper also noted there was, “a white powder residue within the straw.”The results of a field test of the residue was, “consistent with methamphetamine.”The defendant is represented by Public Defender Scott Gropp in the misdemeanor matter. Judge Bauer assigned Gropp to represent him in the new case as well. Gropp was not present at the arraignment. Another hearing is scheduled for May 15.After his arrest, Nutsch posted an additional bond of $7,500 (10 percent). In court, Nutsch asked that a portion of the bond money be returned, noting that other defendants with similar charges had been given a lower bond. Judge Bauer denied the request.“No, I'm not really okay with that,” said Nutsch.
