Ohiowa Man Admits to Violating Probation

An Ohiowa man was sent back to jail after admitting to violating terms of his probation.Zachery A. Kelch, age 24, appeared in Jefferson County District Court on Thursday, December 1, 2022, in the custody of the Jefferson County Sheriff's Office. David J.A. Bargen was the presiding judge.Kelch was sentenced in 2018 to 36 months of probation after pleading guilty to possession of methamphetamine, a class 4 felony, and first offense possession of a concealed weapon, a class 1 misdemeanor.According to Special Prosecutor Tad Eickman, Kelch violated his probation in a number of ways, including failing to report to the probation office as scheduled, failing to report for drug and alcohol testing and traveling outside of Fillmore County without the approval of the probation office.When asked by the judge if he wanted an attorney to represent him, Kelch said, “I don't see any need but if the county wants to appoint one, I don't care.”Kelch then waived his right to an attorney. He admitted to some violations of probation terms, but disputed some of the prosecutor's statements.“I was clean the whole time,” said Kelch. “Not being able to go to the bathroom is an automatic fail.”Bond was set at $50,000 (10 percent). Kelch said, “I wish it was lower but we all make mistakes.”Judge Bargen ordered a PSI (Pre-Sentencing Investigation) and a drug evaluation. Sentencing is scheduled for February 2, 2023.
