In Jefferson County District CourtJody W. Duke, age 41, of Fairbury appeared in Jefferson County District Court on Thursday, May 2, 2024, in the custody of the Jefferson County Sheriff's Office. David J.A. Bargen was the presiding judge. Duke was originally facing a felony charge for failing to update his address with Nebraska Sex Offender Registry. This is not the first time he has been accused of this offense, making the charge a felony. In accordance with a plea agreement, Duke pleaded no contest to a reduce charge of attempt of a class 3 or 3A felony, which is a class 4 felony. He was sentenced to two years in prison.Lindsay R. Pingel, age 44, was originally charged with terroristic threats, a class 3A felony. In accordance with the plea agreement, Pingel pleaded no contest to a reduced charge of assault by threatening or menacing manner, a class 1 misdemeanor. Pingel was sentenced Pingel to 365 days in jail, with credit for six days time served.Brandon F. Whorton, age 36, was originally charged with two counts of possession of a deadly weapon by a prohibited person, each a class 3 felony, and unlawful acts relating to drugs, a class 3 misdemeanor. As a convicted felon, Whorton is not allowed to possess a deadly weapon. He was arrested in possession of a machete. In accordance with the plea agreement, Whorton pleaded no contest to one count of possession of a deadly weapon by a prohibited person. The remaining charges were dismissed. He was sentenced to three years in prison, with credit for 147 days time served, followed by two years of post-release supervision.Jeffery S. Wares, age 55, of Fairbury, was originally charged with leaving the scene of an accident, a class 2 misdemeanor, and driving with a license revoked for DUI, a class 4 felony. In accordance with a plea agreement, Wares pleaded guilty for driving with a revoked license. The other charge was dismissed. Wares was sentenced to two years in prison, with credit for 44 days time served.In Gage County CourtJustin R. Mick, age 39, of Wymore, appeared in Gage County Court on April 25, 2024, where he was sentenced on multiple cases. In one case, Mick is charged with criminal mischief and disturbing the peace, both class one misdemeanors. In a separate case, on August 31, 2023, Mick was alleged to have given, “information he or she knew to be false to a peace officer or other official with the intent to instigate an investigation of an alleged criminal matter or to impede the investigation of an actual criminal matter,” according to the citation. Mick pleaded no contest. On September 13, 2023, Mick was arrested for DUI (Driving Under the Influence of Alcohol), with an allegedly high blood alcohol level of .15, a class W misdemeanor. He was also charged with driving without a license, a class 3 misdemeanor. In accordance with a plea agreement, Mick pleaded no contest to a reduced charge of first offense DUI without the high test enhancement. The charge of driving without a license was dismissed. Mick was sentenced to nine months of probation for each case.
