Warrant Issued for Jose Perez-Nuevas

A warrant was issued for the arrest of a Faibury Man after he failed to appear for court.Jose M. Perez-Nuevas, age 21, of Fairbury, was scheduled to be sentenced in Jefferson County Court on Wednesday, January 18, 2022. Linda Bauer was the presiding judge.Perez-Nuevas was originally charged with possession of methamphetamine, a class 4 felony punishable by two years in prison, nine to 12 months of post-release supervision and a $10,000 fine.In accordance with the plea agreement, the defendant pleaded No Contest to a reduced charge of attempted possession of methamphetamine, a class 1 misdemeanor punishable by up to one year in jail and a $1,000 fine.The Jefferson County Sheriff’s Office conducted a search warrant at a residence in Fairbury on September 15, 2022. According to the Arrest Affidavit, the defendant was located in the basement, “Jose was on the couch under a blanket pretending to be asleep.”A backpack allegedly belonging to the defendant was located near him at the time and a search was conducted. The Arrest Affidavit indicated the backpack contained, “several articles of drug paraphernalia as well as a baggie containing methamphetamine residue.”The defendant was arrested at the scene.Judge Bauer ordered the defendant to contact the Probation Office and complete a PSI (Pre-Sentencing Investigation). Perez-Nuevas failed to do that.Perez-Nuevas is represented by Public Defender Scott Gropp, who said he had not been in touch with his client and requested a continuance. County Attorney objected and requested a warrant.Severe weather was reported on court day, including snow and freezing rain. However, the defendant did not contact his attorney or the court. Judge Bauer said, “Since he didn't show up for the PSI, I don't think I can give him the benefit of the doubt.”Judge Bauer issued the warrant and set a new bond at $7,500 (10 percent). The defendant was free on a $5,000 (10 percent).
