Wymore Man Charged with Assault

A Wymore man is accused of assault and other charges in Gage County.Austin L. Schultz, age 25, is charged with third-degree assault, a class 1 misdemeanor punishable by a year in jail and a $1,000 fine. He is also charged with second-degree trespassing and disturbing the peace, both class 3 misdemeanors that carry a possible penalty of three months in jail and a $500 fine.The alleged incident occurred on April 1, 2022.Schultz was originally scheduled to be arraigned on December 27, 2022, but failed to appear for court. Judge Jeffrey A. Gaertig issued a warrant for the defendant's arrest and set a bond at $2,500 (10 percent).Schultz was arraigned on February 7, 2023.Mick is represented by attorney Lee M. Timan, who filed a Motion for Discovery on February 13.Another hearing is scheduled for February 21. The defendant remains free on bond.This is not Schultz's first brush with the law. He was arrested on April 24, 2020, on a charge of second degree trespassing and refusing to comply with an order to leave, a class 2 misdemeanor punishable by up to six months in jail and a $1,000 fine.Schultz also failed to appear for court in this case and an arrest warrant was issued by Gage County Judge Steven B. Timm.In accordance with a plea agreement, Schultz pleaded Not Guilty to a charge of failing to comply with the command of a citation, a class 3 misdemeanor and was fined $75. The trespassing charge was dismissed.
