Alabama Man Returns to Nebraska to Face Two-Year-Old DUI Charges

An Alabama man has returned to Nebraska to address charges that are more than two years old.Christopher E. Porter, age 43, of Florence, Alabama, is facing charges from 2021 in both Jefferson and Thayer counties.Porter appeared in Jefferson County Court in person on Wednesday, December 20, 2023. Linda Bauer is the presiding judge in both cases and county attorney Joseph Casson is prosecutor in both cases, so both cases were addressed while the defendant was in Jefferson County.In the Jefferson County case, Porter is charged with DUI (Driving Under the Influence of alcohol or drugs) with a blood alcohol level of .15 or greater, a class W misdemeanor. He is also charged with speeding and an open container violation, both infractions.He was arrested in Jefferson County on May 27, 2021 and released on a $3,500 (10 percent) bond. A hearing was scheduled on August 11, 2021, but the defendant failed to appear. A warrant was issued for his arrest.In Thayer County, Porter is charged with DUI with a blood alcohol level of .15 or greater; speeding; an open container violation; reckless driving, a class 3 misdemeanor; and failure to appear while out on bail, a class 2 misdemeanor.The offense date was May 27, 2021, the same as in the Jefferson County charges.Porter had multiple failures to appear for Thayer County Court and a warrant was issued for his arrest.As a result of Porter's failures to appear, a Notice of Suspension was sent to Department of Motor Vehicles.The defendant is represented by attorney Dustin Garrison, who told the court Porter returned to Nebraska to clear up the charges, “My client just got back to the state.”Garrison indicated discussions about a possible plea agreement were ongoing and requested a continuance.Another hearing is scheduled for January 31, 2023 in Jefferson County and February 12, 2024 in Thayer County.
