Blue Springs Man Gets Two Years for DUI

A Blue Springs man with a history of DUI (Driving Under the Influence of alcohol or drugs) has been sentenced to two years in prison.Curt J. Hagerman, age 44, of Blue Springs, was charged in Gage County District Court with fourth offense DUI is a class 3A felony, punishable by up to three years in prison, 18 months of post-release supervision and a $10,000 fine. In addition, Hagerman was charged with driving without an interlock devise, a class 4 felony, punishable by up to two years in prison and a $10,000 fine, as well as driving with an open container, an infraction.Hagerman was arrested on June 8, 2023. At approximately 11:23 p.m. on that date, Gage County Deputies were dispatched to the area of south 66th and Juniper Roads, northeast of Beatrice, responding to a report of a woman in the back of a pickup truck being driven recklessly by Hagerman.The vehicle was pulled over and Hagerman was identified as the driver.According to the deputy that filled out the probable cause affidavit, “I observed that Hagerman had bloodshot eyes and I could smell the odor of an alcoholic beverage emitting from his person. I asked Hagerman for his license, registration, and insurance. Hagerman went back to the truck. When Hagerman opened the truck door, I observed an open White Claw can in the driver’s door. Hagerman admitted to having two beers and admitted the White Claw was his. Hagerman handed me his driver’s license which showed that an interlock was required. I asked Hagerman to perform standardized field sobriety tests to which he refused.”The affidavit also indicates Hagerman refused a breath test and was then arrested at the scene.In accordance with a plea agreement, fourth offense DUI was reduced to third offense and the open container violation was dismissed.Hagerman requested probation. However, presiding Judge Rick Schreiner sentenced the defendant to two years in prison, followed by one year of post supervision, a $1,000 and his driver’s license was revoked for fifteen years.
