Daykin Man Reaches Plea Agreement On Felony Charges

Michael A Radican, 22, of Daykin, appeared in Jefferson County District Court on Thursday, October 7. His attorney, Joseph Murray, advised the court that a plea agreement had been reached. Vicky Johnson was the presiding judge.
Radican originally had three charges filed against him: use of a firearm to commit a felony, which is a class 1C felony that carries a possible punishment of five to 50 years in prison; terroristic threats, a class 3A felony punishable by three years in prison, nine to 18 months of post-release supervision and a $10,000 fine; and third degree assault, a class 1 misdemeanor punishable by one year in jail and a $1,000 fine.
In accordance with the agreement, Radican pleaded No Contact to terroristic threats. The remaining charges were dismissed.
According to a press release from the Jefferson County Sheriff’s Office, on December 4, at 12:15 a.m. Deputies were called to Daykin in reference to an assault that had occurred involving a firearm. The reporting party of the incident indicated that he had been physically assaulted by a male subject, identified as Michael Radican. During the altercation, it was reported Radican pulled a pistol off the ground that he had dropped during the physical confrontation and fired it in the direction of the victim.
Upon speaking with the suspect, identified by authorities as Michael A. Radican, he admitted that there was a physical altercation and that at the time he had a 9mm pistol in his belt. He stated the pistol had fallen to the ground during the physical altercation with the victim when the victim asked him if it was fake, he then took the pistol and fired it into the ground next to the victim.
At this time a 9mm firearm was recovered by law enforcement, as well as a spent casing from the firearm.
Michael A. Radican was then arrested.
Judge Johnson ordered a PSI (Pre-Sentencing Investigation). The defendant is currently on probation in saline County on another matter, so a PSI is already on file. The judge will use the existing PSI to make a determination on sentencing and ordered an update letter from the Probation Office.
Sentencing is scheduled for November 4.
The defendant remains free on a $5,000 (10 percent) bond, with a provision the defendant have no contact with the victim.
