Fairbury Man Charged with Criminal Mischief, Trespassing

Jeremy B. Swartz, age 46, of Fairbury, was arraigned in Jefferson County Court the morning of Wednesday, February 8, 2023. Linda Bauer was the presiding judge.Swartz is charged with criminal mischief. The resulting damage is estimated at less than $500, making the offense a class 3 misdemeanor, punishable by up to three months in jail and a $500 fine.The defendant asked for a continuance, indicating he wanted to speak to an attorney. Judge Bauer granted the continuance. Another hearing is scheduled for February 22.Swartz has another matter pending in Jefferson County Court. In that case, the defendant is charged with second degree trespassing, a class 2 misdemeanor punishable by up to six months in jail and a $1,000 fine; second offense willful and reckless driving, also a class 2 misdemeanor; and disturbing the peace, a class 3 misdemeanor punishable by up to three months in jail and a $5,000 fine.On January 14, 2023, at approximately 4:15 a.m., Jefferson County deputies were called to a residence in Endicott. According to the arrest affidavit, Swartz was advised not to return to the property.The next day, January 15, at approximately 10:42 p.m., deputies responded to another call form the same residence. According to the deputy that filled out the affidavit, “Less than 1 mile North of Endicott on HWY 8 1 witnessed a red 80 body style Chevy Camaro matching the vehicle that Jeremy is known to drive heading north on HWY 8 leaving the area of Endicott. At this time, I turned to follow the vehicle and attempt to make an investigative stop on the vehicle. I activated my emergency lights and began to close distance on the vehicle when the operator shut off the headlights and tail lights. It should be noted that this was done on a highway at night in a rural area with no auxiliary lighting or street lamps.”The deputy stopped the vehicle, identified Swartz as the driver and arrested him.A hearing in this matter is also scheduled for February 22.The defendant remains free on a $1,500 (10 percent) bond.
