Fairbury Man Sentenced For Assaulting Pregnant Woman

Jordan Kuhn of Beatrice appeared in Jefferson County Court for sentencing on Wednesday, February 23, 2022. Linda Bauer was the presiding judge. Kuhn of Beatrice was charged with third degree domestic assault of a pregnant woman, a class 3A felony, which carries a possible punishment of three years in prison followed by 18 months of post-release supervision and a $10,000 fine. Kuhn was arrested on Sunday, September 26, 2021. The defendant was represented by Public Attorney Scott Gropp. However, at a previous hearing on September 29, 2021, County Attorney Joseph Casson noted the details of Kuhn’s financial status indicate his eligibility for court-appointed counsel is “borderline.” Therefore, Kuhn was advised he may be required to reimburse the county’s legal fees. At that hearing, Kuhn told the judge, “This ain’t me. I made a big, big mistake.” Kuhn is currently on probation in Gage County. Judge Bauer ordered an updated PSI (Pre-Sentencing Investigation) from the Probation Office. After reviewing the PSI, Casson said the defendant was “not a suitable candidate for probation” and requested a straight sentence. Through his attorney, Kuhn indicated he felt the PSI was not entirely accurate and requested a fine only or probation. Gropp also noted his client has recently begun some activities recommended by probation, including MRT (Moral Reconation Therapy) classes and relapse prevention classes. The judge said, “I'm glad that you decided to get serious about probation. But it seems like it took about a year and a half to get serious about probation. You've been on probation since September of 2020, and according to the update, you accomplished very little of what you were ordered to do.” “I don't enjoy imposing jail sentences,” said Judge Bauer. “I don't believe a fine is appropriate.” The judge sentenced Kuhn to 180 days in jail. He was then remanded to the custody of the Jefferson County Sheriff's Office to carry out the sentence.
