Imes Seeks Trial For Driving Without A License

Brandon L Imes, 33, of Plymouth, appeared in Jefferson County District Court the morning of Wednesday, September 22, 2021. Linda Bauer was the presiding judge.Imes is charged with driving under a revoked operator's license, second offense, a class 2 misdemeanor that carries a possible penalty of six months in jail, a $1,000 fine and his license could be further revoked for another two years. The defendant was previously convicted of driving under a revoked license on September 13, 2017, in Jefferson County Court.When Imes was arraigned on Wednesday, February 10, County Attorney Joseph Casson indicated his intention to seek jail time.Imes was arrested on January 24, 2021. According to the Affidavit of Probable Cause, at approximately 1:52 a.m., a deputy with the Jefferson County Sheriff's Office, “was patrolling the Village of Plymouth when I observed a red Ford Mustang with no license plates exit the alley between North Madison Avenue and North Jefferson Avenue onto Highway 4. The vehicle accelerated rapidly causing the tires to loose traction and the rear of the vehicle to sway side to side. As I attempted to catch the vehicle, I observed the vehicle traveling eastbound at a high rate of speed. I used my vehicle mounted RADAR unit to determine the speed of the vehicle to be at 123 miles per hour in a 65 mph zone. I initiated a traffic stop on the red Ford Mustang near Highway 4 and 580th Avenue and the vehicle came to rest in a driveway.”Imes asked the judge for more time to consider his options.“I can't give you any more time just to think about things,” said Judge Bauer. “This case has been pending for six months.”Imes then requested a trial and told the judge, “I don't agree with the charge.”The defendant is represented by attorney Ronald Brackle. Imes' previous attorney was Public Defender Scott Gropp but Imes requested a change of counsel on February 10.The judge agreed to set a bench trial, meaning a trial with no jury, and told the defendant the deadline to demand a jury trial was past.“Is my lawyer supposed to know that?” asked Imes. “Isn't he supposed to inform me of that?”Judge Bauer said, “You were informed of that.”Brackle asked that the trial be set for after November 10. His client has a sentencing in Lancaster County scheduled for that date, and the sentence Imes received, probation or incarceration, will likely impact what sentence he asks for in Jefferson County.In Lancaster County, Imes is charged with escape while under arrest on a felony charge, which is a class 3A felony. He is currently free on a $5,000 PR (Personal Recognizance) bond in that case.Imes was convicted in Saline County on June 17, 2019, for attempted receipt of stolen property.
