Possible Plea Deal For Fairbury Man Charged With Aiding And Abetting

Daniel S. Shibley, 28, of Fairbury, appeared in Jefferson County District Court on Thursday, September 9, in the custody of the Jefferson County Sheriff's office. Vicky Johnson was the presiding judge.Shibley was one of three suspects arrested on Monday, April 5. Deputies with the Jefferson County Sheriffs Office served a search warrant at a residence located at the 700 block of 4th Street in Fairbury. Three individuals inside the residence were detained during the course of the search. In addition to Shibley, the other two were identified as Alayna L. Montague and Trey D. Saathoff.According to the Sheriff's office, upon searching the residence, an estimated total of 22.9 grams of methamphetamine were discovered as well as several small baggies of marijuana. In addition to this, $85 dollars in cash was seized as well as amounts of drug paraphernalia relating to marijuana and methamphetamine and items related to the distribution of a controlled substance.In a separate bedroom another estimated 6.9 grams of methamphetamine were discovered as well as prescription medication with the names of the individuals scratched off of the pill bottles.Shibley is charged with four counts; aiding and abetting the manufacture of methamphetamine (between 25 and 140 grams), a class 1C felony, punishable by five to 50 years in prison; aiding and abetting the delivery of zolpidem (a sedative often referred to by the band name of Ambien), a class 3A felony, punishable by three years in prison, nine to 18 months of post-release supervision and a $10,000 fine; possession of methamphetamine and possession of zolpidem, both class 4 felonies, punishable by two years in prison, nine to 12 months of post-release supervision and a $10,000 fine.A trial date has been set for January 27 and 28, 2022, but the defendant's attorney, Matthew Kosmicki, told the judge that a plea offer had been extended and a trial was unlikely.The deadline for plea agreements is December 2. Judge Johnson asked that the court be informed as soon as possible if a plea agreement is set. There are three other trials on the criminal docket for those days.Judge Johnson said, “Jury trials cause us to do a lot of work.”Shibley has been in custody since his arrest on April 4 of this year. Bond was previously set at $100,000 (10 percent). Kosmicki asked for a bond reduction and recommended $50,000.“He's been in custody for some time now,” said Kosmicki. “The bond is set at an amount he cannot reach.”Kosmicki also noted, “He is trying to arrange drug and alcohol treatment.”County Attorney Joseph Casson did not object to the lower bond.Judge Johnson agreed to a $50,000 (10 percent) bond with the understanding that Shibley must follow pretrial release rules, including not possessing and alcohol or drugs not prescribed by a physician.The judge also pointed out that, while Shibley was not currently eligible for drug court due to the charges, he could become eligible should the charges be reduced.Drug Courts are specialized court docket programs that help criminal offenders who have alcohol and other drug dependency problems.
