Tanner Sell Sentenced

After having his sentencing date rescheduled twice, a Fairbury man was given 90 days in jail.Tanner R. Sell, age 37, was originally scheduled to be sentenced in Jefferson County on Wednesday, February 14, 2024. However, sentencing was postponed after the defendant told the court he wanted to dismiss the court-appointed public defender, Scott Gropp, and hire his own attorney. Sell also has a case in Gage County. His attorney in those matters, Stephanie L. Clark, is who he wanted to represent him in Jefferson County as well. So, his case was rescheduled for Wednesday, March 6, 2024.Sell appeared for court on March 6 but without an attorney. Gropp had been excused because the court anticipated a new attorney would be representing Sell. However, Sell advised the court that Clark was unable to take the additional cases.Sell wanted to move forward with sentencing without an attorney.“It's been dragged on for nine moths,” said Sell. “I was willing to represent and take whatever you dish out.”Judge Linda Bauer was unwilling to proceed to sentencing, pointing out that Sell still had the public defender assigned to represent him. Sentencing was rescheduled once again, this time to March 20, so that Gropp could be present.Sell was originally charged with attempted possession of a controlled substance (hydrocodone), a class 1 misdemeanor; unlawful acts relating to drugs, a class 3 misdemeanor; and first offense driving under the influence(DUI), a class W misdemeanor.In accordance with a plea agreement, Sell pleaded guilty to attempted possession and the remaining charges were dismissed.According to a PSI (Pre-Sentencing Investigation), Sell is “not a good candidate for probation.” County Attorney Joseph Casson agreed and asked for a straight sentence.The defendant is on probation in Gage County and is facing a motion to revoke due to this case. Judge Bauer indicated Sell had stopped meeting with probation.“Based on a pretty lengthy criminal history,” said Judge Bauer, she sentenced Sell to 90 days in jail.Sell asked if he could serve his sentence on the weekends but the judge said that was not an option. He then asked for a deferrement for time to get his affairs in order.Judge Bauer denied the request.“If you thought this was going to turn out any way other than jail,” said Judge Bauer. “That's on you.”Sell has another case pending in Jefferson County. He is charged with driving during a time that is license was revoked and not having proof of insurance, both class 2 misdemeanors, and operating a vehicle without proof of ownership, a class 3 misdemeanor.Sell pleaded not guilty and a hearing was scheduled for April 17, 2024.The defendant was then remanded to the custody of the sheriff's office to carry out the sentence.
